Information on exercising the right of withdrawal

1.    Right of withdrawal

1.1.       

As a consumer within the meaning of the Austrian Konsumentenschutzgesetz (KSchG), the consumer has the right to withdraw from the concluded contract within fourteen days without giving reasons.

 

1.2.       

The withdrawal period begins on the day on which the consumer or a third party nominated by the consumer takes delivery of the product.

 

1.3.       

In order to exercise the consumer’s right of cancellation, the consumer must inform Guardian of the decision to withdraw from the contract by means of a clear declaration (e.g. a letter sent by post, fax or e-mail). The consumer can use the sample of withdrawal form on the bottom of this site.

 

1.4.       

To observance the withdrawal deadline, it is sufficient for the consumer to send the notification of exercising the right of withdrawal before the withdrawal period expires.

 

2.    Consequences of withdrawal

 

2.1.       

In the event that the consumer withdraws from the concluded contract, Guardian must refund any payments received from the consumer within fourteen days of the date on which Guardian receives notification of the consumer’s cancellation of this contract. For this repayment, Guardian will use the same means of payment that the consumer used for the original transaction.  

 

2.2.       

Guardian may refuse repayment until Guardian has received the product back or until the consumer has provided proof that he has returned the product, whichever is the earlier. The consumer must return or hand over the product to Guardian immediately and in any case no later than fourteen days from the day on which the consumer informed Guardian of the cancellation of this contract. The deadline is met if the consumer dispatches the product before the period of fourteen days has expired.

 

2.3.       

The consumer only has to pay for any loss in value of the product if this loss in value is due to handling of the product that is not necessary for checking their condition, properties and functionality.

 

2.4.       

If the consumer has made the payment by bank transfer, he has to provide Guardian with his account details, as Guardian can only see part of the consumer’s account details on the bank statement.  

 

2.5.       

The consumer shall bear the direct costs of returning the product. The return shipment of the product must be made via an insured transport corresponding to the value of the product. Guardian will be happy to provide exact price information on request before the purchase, as this depends on the distance, weight and nature of the transport. The consumer shall return the item to Guardian in its original packaging.
